Terms of Use

These are the rules of this place. We have tried to write them so that you can actually read them.


1. Who you are agreeing with

In these terms, we and us means The Don’t Hold Back Project. You means the person using the site.

By creating an account or publishing a declaration, you agree to these terms. If you do not agree with them, please do not use the site.


2. Who can use this

You must be 18 or over. This is not a place for children.

You must be able to enter a contract in the country you live in. One account per person.


3. What this service is

You write something you intend to do. You pay. It appears publicly on the wall, where strangers can read it and stand with you. Later, we ask whether you went.

That is the whole thing. We are not a coaching service, a therapy service, a financial service, or an advisory service. Nothing on this site is professional advice of any kind.

We do not promise that declaring something will make it happen. The declaration is the product. What you do afterwards is your life.


4. What you pay, and what you get

One declaration $7
Five declarations $30
Ten declarations $50

All prices are in Australian dollars (AUD) and include GST where it applies.

A credit entitles you to publish one declaration. Credits do not expire. They can only be spent on declarations — never on words of encouragement, which are free and unlimited once you have published at least one declaration.

Payment is taken by Stripe. We never see or store your card details.


5. Refunds

Your rights under Australian Consumer Law come first, and nothing in these terms limits them.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If there is a major failure — if the service is not delivered, or is significantly different from what was described — you are entitled to a refund or to have the problem fixed.

Beyond those rights, here is our own position, which is deliberately generous:

Unused credits — refundable within 30 days of purchase. If you bought five and used one, ask us within 30 days and we will refund the four you have not used. No reason needed.

After 30 days, credits are not refundable — but they never expire. They stay in your account for as long as you want them, and we will remind you they are there. An unused credit is somebody who paid to be braver and then was not, and we would rather it eventually became a declaration than sat forgotten.

Published declarations — not refundable, because the thing you paid for has been delivered. Your words went up, people read them, and that cannot be undone.

Except where something went wrong on our side — a duplicate charge, a technical failure, a declaration that never appeared. Tell us and we will fix it and refund you.

How. Write to yay@dontholdbackproject.com. We answer within 5 business days and refunds go back to the card you paid with, usually within 10 business days.

If you are in the European Union or the United Kingdom, you normally have a 14-day right to cancel a digital purchase. By publishing a declaration, you ask us to begin the service immediately and you acknowledge that you lose that right for that declaration. Your unused credits are unaffected and remain refundable on the terms above.


6. What you write

Your words stay yours. You own everything you publish here.

By publishing, you give us permission to display it on the site, to include it in search results, and to show it in a shareable link — for as long as it remains published. That permission ends when you delete it.

We may quote declarations to describe the project, for example on social media or in the press. We will never attach your real name, and where a declaration is sensitive we will ask you first.

You keep the right to delete anything you publish, at any time.


7. What you must not write

This place has one rule underneath all the others: here we do not advise, warn, caution, or ask whether somebody is sure.

You must not publish anything that:

  • Threatens, harasses, abuses or incites violence against anyone
  • Is sexual in nature
  • Identifies another living person in a way that exposes or harms them
  • Is somebody else’s words presented as your own
  • Is advertising, spam, or a link to something you are selling
  • Is unlawful, or would encourage somebody else to break the law
  • Describes an intention to harm yourself or another person

In words of encouragement, you must not advise, warn, correct or diminish. A hundred characters and no question marks makes most of that impossible. The rest we screen for.

We check submissions automatically. Content that does not belong is returned to you with an invitation to try again — not a penalty. Repeated deliberate abuse will end your account.


8. If you are struggling

This is not a crisis service, and nobody here is monitoring for emergencies.

If you are thinking about harming yourself, please talk to somebody who can help right now:

  • Australia — Lifeline 13 11 14, available 24 hours
  • International — findahelpline.com will show you the service in your country

If you tell us about a declaration that suggests somebody is in danger, we may remove it and, where we believe there is a serious and imminent risk to a life, we may contact the relevant authorities.


9. Reporting something

Every declaration and every word of encouragement can be reported. Use the report link, or write to yay@dontholdbackproject.com.

We read every report. We may hide content while we look at it. We will act within 48 hours.


10. Your account

You are responsible for keeping your password to yourself.

You can delete your account whenever you like, from your account page. Everything you published goes with it.

We may suspend or close an account that breaks these terms, that is used to harm somebody, or that we are legally required to close. Where we can, we will tell you why, and you can ask us to reconsider by writing to us.


11. What we do not promise

We provide this site as it is. We work hard to keep it running, but we do not promise it will be available without interruption, or free of errors, or that anything you read here is accurate.

To the fullest extent the law allows, and other than the consumer guarantees described in section 5, we are not liable for indirect or consequential loss, or for anything you decide to do as a result of using this site.

Where we are liable, our liability is limited to the amount you have paid us in the twelve months before the claim. For most people that is seven dollars.

Nothing here excludes liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded.


12. Changes

We may change these terms. If a change materially affects you, we will email you at least 14 days before it takes effect. Continuing to use the site after that means you accept the new terms.


13. The law that applies

These terms are governed by the law of Victoria, Australia, and the courts of Victoria have jurisdiction.

If you are a consumer in the European Union, the United Kingdom, or anywhere else with mandatory local consumer protections, this does not take away rights you have under the law of your own country, and you may bring proceedings there.


14. The rest

If any part of these terms is found unenforceable, the rest still stands.

If we do not enforce something immediately, we have not given up the right to enforce it later.

These terms, with the Privacy Policy, are the whole agreement between us.
